1. Purpose of Agreement
This Master Services Agreement (“Agreement”) outlines the general terms under which Hosting Roo Pty Ltd (“HostingRoo”, “we”, “our”) provides services to customers (“you”, “your”). Specific services may be subject to additional policies or agreements.
2. Services Covered
This Agreement applies to all HostingRoo services, including but not limited to:
Shared cPanel web hosting
Domain name registration and management (resold)
Microsoft Office 365 licensing and support (resold)
Technical support, billing, and related account services
3. Term and Renewal
Services are available on monthly, annual, biennial (2-year), or triennial (3-year) terms.
All services renew automatically unless cancelled prior to renewal.
You may cancel anytime via the client portal. Refunds are only available under our 30-Day Money-Back Guarantee.
4. Payment Terms
All invoices are in AUD by default (or set to the currency of your billing account) and must be paid by the due date.
Overdue accounts are suspended first, and will be terminated if unpaid.
HostingRoo reserves the right to adjust pricing with prior notice.
5. Acceptable Use
You must comply with our Acceptable Use Policy, which prohibits illegal, abusive, or spam-related behaviour.
Violations may result in service suspension or termination without refund.
6. Service Levels
We target 99.99% uptime for shared hosting services. If uptime falls below this threshold, credits may be issued in accordance with our Service Level Agreement.
7. Data and Backups
HostingRoo performs routine backups for internal use. However, you remain solely responsible for maintaining your own data backups.
We strongly recommend maintaining independent, offsite backups for critical data.
8. Privacy
We manage personal information in accordance with our Privacy Policy.
Your data may be shared with third parties (e.g., registrars, Microsoft) strictly for service delivery purposes.
9. Resold Services
Certain services (e.g., Office 365, domain registration) are resold from third-party providers. You agree to comply with any additional terms from those providers. HostingRoo is not liable for outages or service disruptions caused by third-party platforms.
10. Customer Responsibilities
You agree to:
Keep your contact and billing details up to date
Secure your login credentials
Use services lawfully and respectfully
Cooperate with HostingRoo staff for support or compliance purposes
11. Termination
Either party may terminate this Agreement with written notice.
HostingRoo may suspend or terminate services for policy violations, abuse, or non-payment.
Terminated services are non-refundable, except where the 30-Day Guarantee applies.
12. Liability and Warranties
Services are provided “as-is” without warranties of any kind.
To the extent permitted by law, HostingRoo disclaims liability for indirect or consequential loss, including data loss.
Our maximum liability is limited to the fees paid for the affected service in the prior three months.
13. Modifications
HostingRoo may update this Agreement at any time. Changes will be published at https://www.hostingroo.com and take effect immediately upon posting.
Continued use of services indicates acceptance of the revised terms.
14. Governing Law
This Agreement is governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of its courts.
